New York ERPO/ “Red Flag” Bill

An ERPO/”Red Flag” law would help prevent mass shootings and suicides.

The Extreme Risk (“Red Flag”) Protection Order bill would keep guns away from individuals in crisis by empowering family and household members, law enforcement, and school officials to petition a court to temporarily remove guns from individuals who are dangerous to themselves or others. The laws have proven to be effective in reducing mass shootings, suicides, domestic gun violence, and other gun crimes.

New York Background Check Extension Bill

While New York State’s background check system requires a background check on most gun sales (including by unlicensed sellers) at gun shows and online, if the background check is not completed within three days the seller is allowed to move forward with the sale. The New York Background Check Extension bill would extend the background check period up to 30 days to ensure the buyer is safe to own a firearm.

Federal Background Checks Bill

H.R. 8 would close loopholes in the federal background check system.

Democrats in the U.S. House recently introduced H.R. 8, the Bipartisan Background Checks Act of 2019. The bill would require a background check on every gun sale or transfer, with carefully defined exceptions for gifts to family members, hunting, target shooting, and self-defense. While licensed gun dealers are currently required to conduct background checks, H.R. 8 would require unlicensed gun sellers to utilize this same system by requiring them to sell or transfer firearms only through licensed dealers.

This bill would close a huge loophole in federal law that allows unlicensed sellers to sell guns at gun shows, online, and person-to-person without conducting any background check on the purchaser. Since up to 80% of firearms used for criminal purposes are obtained without background checks, this bill is vital to reducing gun violence throughout the country.
