According to Alphonso David, Counsel to New York Governor Andrew Cuomo, the Governor has no intention to roll back any provision of the NY SAFE Act and doesn’t have the authority to do so.

David issued a statement to clarify misunderstandings about the Governor’s recent memorandum of understanding with the state’s Senate Republicans agreeing to suspend the ammunition background check requirements that are part of the NY SAFE Act. NYAGV and other gun violence prevention groups had strongly opposed the memorandum.

According to David’s statement, “There have been concerns raised that the State should not implement the database prematurely as it could cause unmanageable disruption in retail establishments and could cause undue delays. We agree. . . To be clear, the memorandum reiterates the administration’s intention to implement a functional database when it is ready and reinforces that the system cannot be launched prematurely. ”
